Acceptable Use Policy, how not to use Gaplessly

Part of the Terms of Service. Applies to every business and every staff member.

1. Messages and marketing

  • Only send marketing to customers who opted in through your booking page, or who are covered by the permission declaration you made in your settings. That declaration is your statement about your own list, not ours.
  • Every marketing message must say who it is from and how to contact you, and you must honour every unsubscribe and every STOP reply. Our tools add the unsubscribe and record it automatically; disabling, hiding or working around them is a breach of this policy.
  • Do not upload contact details you have no permission to hold.
  • If your text messages show your business name as the sender, that name has to be registered on Australia’s SMS Sender ID Register, which runs through the messaging provider; since 1 July 2026 an unregistered name is shown to the recipient as Unverified.
  • Sending marketing without consent very likely breaches the Spam Act 2003 (or New Zealand’s Unsolicited Electronic Messages Act 2007), under which penalties fall on you as the sender. We may suspend marketing sending on an account that generates complaints.

2. Honest reviews

  • Do not write reviews of your own business, or ask staff, family or friends to pose as customers.
  • Do not offer a discount, gift or anything else in return for a review, or for a particular rating.
  • Do not present your private feedback form as if it were a public review site, or tell a customer their feedback has been published when it has not.
  • Follow Google’s own review policies when you send customers to your Google Business Profile.
  • A review request is very likely a commercial message under the Spam Act 2003, so send it only to customers you have a consent basis for, let it identify your business, and honour any opt-out.

3. Businesses Gaplessly is not for

  • Anything unlawful where you or your customers are, or a service you need a licence for and do not hold.
  • Adult sexual services, weapons, illegal drugs, or gambling.
  • Health services that need clinical or patient records. Gaplessly does not yet support those safely.
  • To take payments, your business must also be one Stripe accepts; Stripe’s own list of restricted businesses applies, and payments can be switched off separately from the rest of your account.
  • Where you sell alcohol, therapeutic goods or age-restricted experiences, the licensing and age-check rules for them are yours to follow.

4. Content

  • Publish only photos, logos, video, music, fonts and text you have the rights to use (section 9 of the Terms explains this).
  • No content that is unlawful, misleading, defamatory, hateful or harassing, and no sexually explicit material or anything harmful to children.
  • No personal information about other people that you have no right to publish.

5. Security and fair use

  • Do not try to reach another business’s data, probe our defences, or work around a plan limit.
  • Do not overload the API beyond its documented rate limits, scrape the service, or upload malware.
  • Do not resell or white-label the dashboard itself. Your booking page carries your branding by design; the dashboard behind it does not become your product.
  • Do not use the AI features to produce anything this policy forbids, or to impersonate someone.

6. Reporting a problem
